Ancak buna gerek\u00e7e sa\u011flayan \u201cnamus\u201d, hem kavramsal hem pratik d\u00fczeyde, toplumsal cinsiyet(ler)in yeniden \u00fcretimi ba\u011flam\u0131nda ayr\u0131ca incelenmelidir.&nbsp;<\/p>\n\n\n\n<p>\u00d6yle ki, T\u00fcrkiye\u2019de de \u00e7ok\u00e7a birbirinin yerine kullan\u0131lmas\u0131na ra\u011fmen \u201cnamus\u201d ve \u201ct\u00f6re\u201d e\u015f kavramlar de\u011fillerdir. Elbette t\u00f6re de bir namus alg\u0131s\u0131n\u0131n \u00fczerine kuruludur ve t\u00f6re cinayetleri de birer namus cinayetidir. Ancak t\u00f6re, belli bir d\u00f6nemin ve ya\u015fay\u0131\u015f\u0131n yasas\u0131 olarak, de\u011fi\u015fim ve geli\u015fim kar\u015f\u0131s\u0131nda dura\u011fanla\u015fm\u0131\u015f ve tarihd\u0131\u015f\u0131 kalm\u0131\u015f \u2018eski\u2019bir \u2018namus\u2019lu ya\u015fam yorumunu i\u015faret eder. Mesela, berdel bu farka g\u00f6re art\u0131k modern d\u00fcnyan\u0131n uygulamalar\u0131ndan biri de\u011fildir; uyulmamas\u0131 bu sistemi \u2018namussuz\u2019 k\u0131lmaz. O bir t\u00f6redir ve art\u0131k ak\u0131ld\u0131\u015f\u0131d\u0131r! Namus ise \u00e7oktan yeni i\u00e7eri\u011fine b\u00fcr\u00fcnm\u00fc\u015ft\u00fcr. \u00c7\u00fcnk\u00fc o, toplumsal de\u011fi\u015fime paralel ve toplumsal cinsiyetin bu de\u011fi\u015fim kar\u015f\u0131s\u0131ndaki seyrine i\u00e7kin olarak yeniden i\u00e7erik ve pratik kazanan bir canl\u0131l\u0131\u011fa sahiptir.<strong>(1)<\/strong> Toplumsal de\u011fi\u015fimin ataerkil yap\u0131, zihniyet ve s\u00f6ylemi yeniden \u00fcretti\u011fi noktada ise, bu canl\u0131l\u0131k bizzat sistemin me\u015frulu\u011funun ta\u015f\u0131y\u0131c\u0131s\u0131 olur. Ba\u015fka bir deyi\u015fle, her sistem namusludur!\u00a0<\/p>\n\n\n\n<p>Bu nedenle, T\u00fcrk Ceza Kanunu\u2019nda 2005\u2019te y\u00fcr\u00fcrl\u00fc\u011fe giren de\u011fi\u015fiklik (Yeni TCK\u2019n\u0131n 82\u2019nci maddesinin (k) f\u0131kras\u0131nda, kasten insan \u00f6ld\u00fcrme su\u00e7unun t\u00f6re saiki ile i\u015flenmi\u015f olmas\u0131 durumunda a\u011f\u0131rla\u015ft\u0131r\u0131lm\u0131\u015f m\u00fcebbet hapis cezas\u0131 uygulanaca\u011f\u0131 belirtilir), t\u00f6re cinayetlerinde haks\u0131z tahrik indirimini kald\u0131r\u0131rken, namus gerek\u00e7esi ile i\u015flenen cinayetlerde a\u011f\u0131r tahrik indirimini \u00e7e\u015fitli gerek\u00e7eler yaratarak ilen uygulamaktad\u0131r ve daha da \u00f6nemlisi, bu indirimler h\u00e2kimin takdirine b\u0131rak\u0131lm\u0131\u015ft\u0131r. Ba\u015fka bir ifadeyle, modern olman\u0131n, geli\u015fkinli\u011fin bir ifadesi olarak kar\u015f\u0131 durulan, feodal ve ona yerle\u015fmi\u015f dinsel kal\u0131nt\u0131lard\u0131r; yoksa duyarl\u0131l\u0131k, ataerkil sisteme bir tepki noktas\u0131ndan k\u00f6k almaz.&nbsp;<\/p>\n\n\n\n<p>Ayn\u0131 alg\u0131, Bat\u0131\u2019n\u0131n bu cinayetlere ve Do\u011fu\u2019ya bak\u0131\u015f\u0131n\u0131 da belirlemektedir.
